1. Acceptance of these terms

By accessing or using this website, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the website or submit a form.

“Vinward”, “we”, “us” and “our” refer to Vinward. “You” refers to the visitor, person submitting an enquiry or organisation on whose behalf the website is used.

2. Website information

The website provides general information about Vinward, marketing topics and possible services. Content is provided for general business information and is not legal, financial, tax, cybersecurity or other regulated professional advice.

Vinward aims to keep information useful and current but does not promise that every page is complete, accurate, available or suitable for a particular purpose. You are responsible for evaluating information before relying on it or making a business decision.

3. Free Growth Audit and enquiries

A Free Growth Audit is a limited initial review based on public information and the context you provide. It is intended to identify possible priorities and sensible next steps. It is not a comprehensive audit, assurance engagement, valuation or guarantee of performance.

Submitting a form, sending a message or receiving an audit does not create a client relationship, exclusivity, confidentiality obligation or commitment to provide paid services. Vinward may decline or stop reviewing a request where information is incomplete, the request is unsuitable, there is a conflict or capacity is unavailable.

You confirm that information you submit is accurate to the best of your knowledge and that you have authority to share it. Do not send passwords, private customer data, confidential trade secrets or sensitive personal information unless Vinward has expressly agreed on a secure method and purpose.

4. Paid services and separate agreements

Any paid strategy, marketing, design, development, automation or related service will be governed by a separate proposal, statement of work, contract or written acceptance. That agreement should define scope, responsibilities, fees, timing, intellectual property, confidentiality, data handling, dependencies and termination.

If these website terms conflict with a signed client agreement, the signed agreement controls for the services covered by it.

5. No guaranteed marketing outcomes

Marketing, search visibility, advertising, conversion and commercial results depend on many factors outside Vinward’s control, including market conditions, competition, platform decisions, budgets, implementation, sales activity and customer behaviour.

Unless a signed agreement expressly states otherwise, Vinward does not guarantee rankings, traffic, leads, conversion rates, sales, revenue, platform approval or continued access to a third-party service. Examples, observations and forecasts are not promises of future performance.

6. Intellectual property

The website, brand, design, copy, graphics, frameworks and other original materials are owned by or licensed to Vinward and are protected by applicable intellectual-property laws.

You may view, print or save reasonable extracts for your own internal, non-commercial evaluation. You may not reproduce, republish, sell, scrape, train a competing dataset from, remove attribution from or create derivative commercial materials from the website without prior written permission, except where applicable law permits.

Third-party names, logos, content and trademarks remain the property of their respective owners.

7. Acceptable use

You must not:

• use the website for unlawful, fraudulent, abusive or misleading activity;
• attempt to bypass security, probe vulnerabilities or disrupt availability;

To the fullest extent permitted by law, Vinward will not be liable for indirect, incidental, special, consequential or punitive loss arising from use of, inability to use or reliance on the website, including loss of profit, revenue, opportunity, data or goodwill.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Liability relating to paid services will be governed by the applicable written client agreement.

10. Changes, severability and disputes

Vinward may update the website and these terms. Changes apply from the revised effective date shown above. Continued use after an update means the revised terms apply to later use.

If part of these terms is found unenforceable, the remaining provisions continue to apply. A failure to enforce a provision immediately is not a waiver of that provision.

Unless a separate written agreement states otherwise, questions or disputes should first be raised with Vinward in good faith. Governing law and jurisdiction will be determined by the law applicable to Vinward, the relevant transaction and any mandatory rights that apply to you.
